غطت أحكام وقواعد القوانين الدولية لحقوق الإنسان، جريمة الإغتيالات والتصفيات السياسية بكم من النصوص الواضحة الراسخة الحاسمة، التي تدين كل من يخالفها بإقتراف جريمة حرب تستدعي جلبه وتقديمه لمحكمة جرائم الحرب الدولية.
فقد جاء في نص المادة العاشرة من الإعلان العالمي لحقوق الإنسان "لكل إنسان على قدم المساواة التامة مع الآخرين الحق في أن تنظر بقضيته محكمة مستقلة ومحايدة، نظراً منصفاً وعلنياً للفصل في حقوقه وإلتزاماته وفي أية تهمة جزائية توجه إليه".
وجاء في المادة 11/ 1 من الإعلان أيضاً "كل شخص متهم بجريمة يعتبر بريئاً إلى أن يثبت إرتكابه لها قانوناً في محكمة علنية، تكون قد وفرت له فيها جميع الضمانات اللازمة للدفاع عن نفسه".
