تهدف هذه الدراسة إلى بيان "دور محكمة العدل الدولية في تطوير وظيفة منظمة الأمم المتحدة"، ومعالجة الإشكاليات التي تعوقها في أداء هذا الدور على أفضل وجه.
لذلك تبرز أهمية هذه الدراسة في أنها تتناول دور الجهاز القضائي الرئيسي للأمم المتحدة في تطوير الوظيفة الأساسية للمنظمة الدولية والمتمثلة "بحفظ السلم والأمن الدوليين" وفقاً للميثاق. فقد أصدرت محكمة العدل الدولية العديد من التدابير المؤقتة من أجل منع تفاقم النزاعات الدولية أثناء مرحلة نظرها، كذلك ساهمت بفعالية في تسوية النزاعات الدولية، من خلال أحكامها النهائية التي تحوز حجية الأمر المقضي به لحظة صدورها.
كما أرست محكمة العدل الدولية العديد من المبادىء القانونية التي صارت متعارفاً عليها في العمل الدولي وأصبحت مرجعاً أساسياً للفصل في أي نزاع حدودي بين دولتين أو أكثر. كذلك طورت المحكمة المذكورة القانون الدولي، في شتى فروعه.
ومن أجل الإحاطة بكل جزئيات دور م.ع.د. في تطوير وظيفة منظمة الأمم المتحدة، ومعالجة الإشكاليات التي طرحناها، لا بد لنا أن نتعرف على الجوانب التحقيقيية لوظيفة الأمم المتحدة في نشاط م.ع.د.، ثم نبين الجوانب التطويرية لوظيفة المنظمة الدولية في نشاط هذه المحكمة الدولية.
وعليه سنقسم هذا البحث إلى قسمين:
القسم الأول: الجوانب التحقيقية لوظيفة منظمة الأمم المتحدة في نشاط محكمة العدل الدولية. من خلال بيان: دور م.ع.د. في منع تفاقم النزاع الدولي، ودورها في تسوية نزاعات الحدود الدولية.
القسم الثاني: الجوانب التطويرية لوظيفة منظمة الأمم المتحدة في نشاط محكمة العدل الدولية. من خلال بيان: دور م.ع.د. في تفسير وتطوير اختصاصات أجهزة منظمة الأمم المتحدة، ودورها في تطوير القانون الدولي.
