أبرز الواقع الحالي في المجتمع وجود العديد من الإشكاليات بسبب حرية العقيدة وممارسة الشعائر الدينية، ومدى توافقها أو تعارضها مع الواقع الحالي في المجتمع، فقد أظهرت الأحداث الراهنة الحاجة إلى دراسة حرية العقيدة وممارسة الشعائر الدينية دراسة موضوعية لا تعرف الهوى، وفي محاولة متواضعة منا لإقامة موازنة بين النصوص الدستورية والقانونية من جهة، وبين نصوص الإتفاقيات والمعاهدات الدولية من جهة أخرى، ورؤية الشريعة الإسلامية من جهة ثالثة، فقد قمنا بسرد لحرية العقيدة وممارسة الشعائر الدينية من خلال تلك النصوص، وقد استخدمنا في بحثنا هذا المنهج الوصفي والمقارن والتحليلي بهدف الوصول إلى صيغة من الترابط بين النصوص التشريعية الدستورية والقانونية، والقواعد الدولية مقارنة بالشريعة الإسلامية، وربط ذلك بالواقع العملي وبالأحكام القضائية الصادرة في هذا الشأن، وسوف نتناول هذا الموضوع من خلال الفصول التالية:ـ الفصل الأول: حرية العقيدة وممارسة الشعائر مفهومها وقيودها، الفصل الثاني: الحماية الدولية لحرية العقيدة وممارسة الشعائر، الفصل الثالث: الحماية التشريعية لحرية العقيدة وممارسة الشعائر، الفصل الرابع: حماية حرية العقيدة وممارسة الشعائر في الشريعة، الفصل الخامس: المشكلة البهائية مدى اعتبارها من الأديان.
