امتاز الفقه الإمامي عن غيره بأنه لم يغلق باب الإجتهاد، فظل الإجتهاد على أثر ذلك رافداً مهماً لتطور الفكر الإسلامي، وأداة للتعامل مع المستجدات في كل عصر، لقد أجهد علماء الأمامية أنفسهم بعد الغيبة الكبرى للإمام المهدي أرواحنا فداه في أداء الأمانة التي أنيطت بهم في قيادة الأمة والتصدّي العلمي لحلّ مشكلاتها على مختلف الأصعدة، لذا زخرت المكتبات ببراع أقلامهم وجهودهم في إستنباط الأحكام الشرعية من مصادرها.
أما في عصورنا القريبة فإن كثرة المسائل المستجدة التي نتجت من التقدّم العلمي، وإكتشاف طرق حديثة في التعامل مع حاجات الفرد والمجتمع، وجد الفقهاء أنفسهم أمام عشرات المسائل الطبية، والإقتصادية، والأسرّية، وسائر فنون المعرفة تحتاج إلى إعمال جهدٍ فقهي معمّق لبيان الحكم الشرعي بشأنها، فمن أحكام الصلاة في القطب الشمالي حيث النهار يستمر لستة أشهر وكذلك الليل، إلى التشريح والتّبرع بالأعضاء، والجراحة التجميلية، والإستنساخ والتأمين بأنواعه... هذه المسائل كلّها ألقت بثقلها على عاتق الفقهاء في إبداء الموقف الشرعي تجاهها.
من هذه المسائل التي كان لها صلة بالإنجاب وإستمرار النسل، طُرحت موضوعات أطفال الأنابيب، وتحديد النسل، وإستئجار الأرحام وعشرات الأمور المتفرعة منها، هنا بدأت المحاولات الفقهية لإختبار الآراء والأقوال المحتملة في كل مسألة من هذا القبيل، ومن الطبيعي أن تظهر على الأفق فتاوى مختلفة، شأنها في ذلك شأن الإختلاف بين أصحاب الخبرة في كل مسألة علمية أو عملية.
فمثلاً عالج الفقهاء مسألة تحديد الأّم عندما يؤخذ السائل المنوي من رجل، ويلّقح ببويضة زوجته، وبعد إنعقاد النطفة وتأهّلها للإستقرار في الرحم، يتم الإتفاق مع امرأة أخرى يصلح رحمها لإنضاج الجنين حتى تتمّ الولادة، فتقوم صاحبة الرحم المستأجرة برعاية الجنين حتى الولادة، هنا يُطرح السؤال: من هي الأّم؟... هل هي التي أخذت البويضة منها؟... أو هي حملت الجنين وغذّته من أحشائها وعواطفها طوال فترة الحمل؟....
