ترتبط كرامة الإنسان إرتباطاً وثيقاً بحياته الخاصة حيث أن الحياة الخاصة قطعة غالية عزيزة من الكيان الإنساني لا يمكن إنتزاعها من الإنسان ولا تحول إلى أداة صماء عاجزة عن القدرة على الإبداع الإنساني والإبتكار. كما أنه يوجد شعور عميق داخل كل كائن إنساني يتطلب حماية سرية للحياة الخاصة ومن ثم يوجد ارتباط وثيق بين الحياة الخاصة والكرامة الإنسانية لأن الحياة الخاصة هي قلب الحرية في الدول الحديثة وقيل أنها قلب الحرية النابض أو النواة لهذا القلب وبدونه لا يصبح للحرية قيمة. ورغم هذا فإن التقدم العلمي في أجهزة التجسس الحديثة أصبح يشكل خطراً جسيماً على سرية وحرمة الحياة الخاصة.
كما حدث تطور هام وخطير في أجهزة التصنت وأجهزة التصوير، حيث يمكن تصوير الأشخاص الموجودين في الغرف المظلمة عن طريق الشعة تحت الحمراء، ويضاف إلى ما تقدم التطور السريع في وسائل النشر الحديث سواء كان ذلك عبر الصحف أو القنوات الفضائية بالإضافة إلى التطور الكبير في مجال الحاسبات وشبكات التواصل الإجتماعي بحيث أصبحت وسائل الإتصال هذه تشكل خطراً حقيقياً يهدد أمن وسرية وخصوصية الحياة الخاصة وعلى هذا ونظراً لأهمية الحياة الخاصة للإنسان ونظراً لتزايد المخاطر التي تهدد أمن الحياة الخاصة فقد تصديت لهذا الموضوع بالدراسة في هذا البحث من خلال خطة البحث التالية: الباب الأول: مفهوم الحق في الحياة الخاصة (فصل تمهيدي: تعريف الحياة الخاصة، الفصل الأول: خصائص الحق في الحياة الخاصة، الفصل الثاني: مظاهر الحق في الحياة الخاصة)، الباب الثاني: أحكام دعوى التعويض عن ضرر الحياة الخاصة (الفصل الأول: الاعتداء على الحق في الحياة الخاصة، الفصل الثاني: التعويض عن ضرر الحياة الخاصة).
