إذا كانت العودة إلى الأصل أصلاً كما يقول الفقهاء المسلمون، فإن عودتنا إلى موضوع الحماية القانونية للجنين في ظل ما يقع عليه من شتى أنواع العدوان، تكون عودة هادفة كاشفة لمظاهر هذا الجحود والعدوان على الذات الإنسانية وفي برزخها الأول التي بدأت تتكون وتتكافل فيه.
وقد رأينا أن يقوم منهجنا في نطاق هذا البحث على أسس المنهج الاستقرائي التحليلي المقارن، بحيث نستقرئ مواقف وأحكام التشريع الوضعي، ثم نحلل هذه النصوص لتظهر ما اشتملت عليه من أحكام، وما يمكن أن يترتب عليها من نتائج تمس الحياة الإنسانية/ الإجتماعية في مقابل أحكام الفقه الإسلامي، ونظرة الأديان ومبادئ الأخلاق.
وعلى هذا، سنسير- بعون الله- لإظهار وإبراز هذه الجوانب من خلال تحليلنا للطبيعة القانونية للجنين.
ثم ننتقل من ذلك لتبين مضمون حماية هذه الذات في جانبها المدني وجانبها الجنائي، لنتمكن في الختام من تقرير النتائج التي نستطيع استنباطها من خلال هذا البحث.
وعليه، تتوزع موضوعات بحثنا هذا وفقاً للمخطط التالي: مدخل تمهيدي ونحدد فيه الطبيعة القانونية للجنين، باب أول ونتناول فيه بيان الحماية المدنية للجنين، باب ثان ونحلل فيه الحماية الجنائية للجنين، خاتمة ونقرر فيها ما نستطيع أن نستبطه من نتائج من خلال هذا البحث.
