لم نجد شريعة من الشرائع السماوية أو الوضعية اهتمت بالطفل وأرست له حقوقاً مثلما فعلت الشريعة الإسلامية، وهذا نابع من كونها خاتمة الشرائع فليس بعدها شريعة، وحينما اهتمت الشريعة الإسلامية بالطفل فقد اهتمت به حتى من قبل أن يوجد.
وبعد أن يخرج هذا الجنين من بطن أمه ليرى نور الحياة، فقد أوجبت له الشريعة الإسلامية حقوقاً في ذمة من يتولى أمره ومنها: عدم وأده حياً كما كان يحدث في الجاهلية، التسمية بأحب الأسماء- وهو موضوع البحث- وجوب النفقة له ورعايته صحياً، ودينياً وثقافياً.
وحيث أن الاسم يعتبر من مميزات الشخصية، فهو الذي يميز كل شخص عما سواه، فلا يعقل أن يكون الشخص بلا اسم لما في ذلك من خلط بينه وبين باقى أشخاص الجماعة، ومن ثم فقد قررت الشريعة الإسلامية والقانون الوضعي على حد سواء عدم الجواز لأى شخص أن يعتدى على اسم غيره أو ينتحل اسمه.
وقد قسمت هذا البحث إلى تمهيد ومبحثين وخاتمة. التمهيد وذكرت فيه التطور التاريخي للاسم، المبحث الأول الطفل وأحقيته في اتخاذ اسم له في الشريعة الإسلامية والقانون الوضعي، المبحث الثاني مدى التعويض عن الاعتداء على الاسم في الشريعة الإسلامية والقانون الوضعي.
