إن كتاب القواسم المشتركة لعيوب الرضى يعتبر من المؤلفات ذات الموضوع التقليدي، وإنما ما حوته دفتا هذا الكتاب يخرجه من إطار العمل التقليدي إلى إطار العمل المتجدد الذي أغنى هذا الموضوع وطوره وذلك بنظرة ثاقبة أحاطت بعيوب الرضى جميعاً في محاولة من المؤلف باستيعاب هذه العيوب من وجهة نظر لم يسبقه إليها مؤلف في السابق. فالمعالجة جاءت رصينة، متعمقة، شاملة لجميع ما عرض على القضاء اللبناني من أحكام منشورة وغير منشورة، بحيث أنه خرج متجلياً لجميع ما استقر عليه الاجتهاد أو توصل له. ولم يتوقف المؤلف عند القانون اللبناني، بل إنه خرج من إطاره إلى القانون المقارن حيث صور الوضع الحالي لمفهوم عيوب الرضى في عدد من التشريعات على اختلافها وتضاربها، متوصلاً إلى إيجاد قواسم مشتركة لهذه العيوب، استطاع من خلالها أن يضعها في قالب واحد من التمييز فيما بينها من حيث الخصوصيات التي أغنت هذا المؤلف.
وقد أبدى المؤلف آراء جديدة لم يسبقه إليها أي من المؤلفين الذين عالجوا موضوع عيوب الرضى. فعلى سبيل المثال اعتبر أن الاستغلال يعتبر قاسماً مشتركاً لعيوب الرضى كافة، وكما اعتبر أن الخطأ هو قاسم مشترك لجميع هذه العيوب باستثناء الأهلية، كذلك الأمر بالنسبة لسبب العقد الذي اعتبره قاسماً مشتركاً لعيوب الرضى بشكل عام وللغلط بشكل خاص.
وقد يستغرب القارئ أن يجد في هذا المؤلف أن هناك عيباً في السبب منفصل عن العيب في الرضى، ومؤد إلى الانعدام، إلا أن التحليل الذي أرساه المؤلف يدل على تفرده في اتخاذ منحى خاص به.
وأن الجرأة التي أبداها المؤلف وخروجه عما هو مألوف بهذا الخصوص يجعل من هذا المؤلف فريداً من نوعه بما يميزه عن سواه، فهو جامع، مانع، واضح، ويمكن، لأي قارئ أن يراجع الفهرس حتى يستدل من خلاله، وبالمنطق القانوني، إلى المسألة التي يمكنه أن يرى حلاً فيها.
