يتناول هذا الكتاب "ضمان العيوب وتخلف المواصفات في عقود البيع" الأصول التاريخية في شرائع الغرب والشرق إذ يبدأ بالقانون الروماني والإنجليزي و شريعة حمورابي والشريعة الإسلامية والبلدان العربية الحديثة وينتقل في الباب الأول إلى ماهية العيب وتخلف الوصف في عقد البيع وأركان ضمانهما في الفقه الإسلامي التشريعات المقارنة القوانين الغربية والعربية وماهية تخاف الوصف في قوانين أوروبا الغربيين وخصوصا في القانون الفرنسي والإنجليزي ثم ماهية تخلف الوضع في التشريعات العربية وفي القوانين التي تطبق في أوروبا الشرعية ثم يشير إلى العيب وأركانه في الشريعة الإسلامية وأركانه في قوانين أوروبا الغربية ثم يحدد شروط ضمان العيب ومنها القوم والخفاء التقليدي وعدم علم المشتري بالعيب ثم بيان شروط الخفاء و عدم علم المشتري بالعيب ويوضع في الباب الثاني ضمان العيب وتخلف الوصف في عقد البيع في ضوء العلاقات التعاقدية الجدية وتمييزه عما يختلط به من أنظم قانونية كالتمييز بين ضمان العيب والغلط والتمييز بين ضمان العيب والتغرير مع الغبن والتمييز بين ضمان العيب ورداءة المبيع ثم يورد أحكام الضمان في عقد البيع ومنها دعوى الضمان وطرفاه والإخطار الذي يسبق دعوى الضمان وآثار دعوى الضمان في الفقه الإسلامي وفي القوانين المختلفة وفي قوانين أوروبا الغربية وفي القوانين العربية ثم يشير إلى التزامات البائع في ظل المتغيرات الاقتصادية وآثار دعوى الضمان في قوانين أوروبا الشرقية وآثارها في عقود شركات القطاع العام ثم يبين الاتفاق على تعديل أحكام الضمان والحالات التي يسقط فيها ومنها تخفيف أو زيادة الضمان والإعفاء من الضمان ثم يشير إلى حالات أخرى لسقوط الضمان كهلاك المبيع وتصرف المشتري بالمبيع قيل العلم بالعيب أو زيادة أو تحول المبيع بالعيب.
