يعد العنف الأسري ظاهرة إجتماعية تعاني منها الكثير من المجتمعات، وتعد هذه الظاهرة نتاج لما اعترى وظيفة التنشئة الإجتماعية في النظام الأسري من تغيرات نشأت كظواهر سلبية للمدنية الحديثة.
ويشكل العنف الأسري خطورة كبيرة على حياة الفرد والمجتمع، فهو من جهة يصيب الخلية الأولى في المجتمع بالخلل، مما يعيقها عن أداء وظائفها الإجتماعية والتربوية الأساسية، ومن جهة أخرى يساعد على إعادة إنتاج أنماط السلوك والعلاقات غير السوية بين أفراد الأسرة الواحدة، مما يستوجب الإهتمام العلمي بهذه الظاهرة للحد منها والوقاية مما قد ينتج عنها من تبعات.
كما أن ظاهرة العنف الأسري لا تقتصر على مجتمع دون آخر، أو على عدد محدود من الدول، وإنما هو سمة تشترك فيها بلدان كثيرة، لا فرق في ذلك بين الدول الغربية التي حققت درجة كبيرة من التقدم الإقتصادي والتكنولوجي والإستقرار السياسي، والدول الشرقية التي ما زالت تعاني من إختلالات في هذه المجالات كلها.
مع الفرق أن المجتمعات الغربية تعترف بوجود هذه الظاهرة وتعدها مشكلة حقيقية وتعمل على معالجتها بشتى السبل والوسائل، في حين أن المجتمعات الشرقية، لا سيّما المجتمعات العربية، تعتبر العنف الأسري من الخصوصيات العائلية والأمور المحظور بحثها وتناولها.
وقد حاولنا في هذا المؤلف دراسة العنف الأسري بشقيه الموضوعي والإجرائي، وذلك من خلال بيان مفهوم العنف الأسري وأشكاله ودوافعه، وآثاره السيئة، وبيان الأفعال التي يعد إرتكابها عنفاً أسرياً يعاقب عليها القانون، وكذلك بيان الإجراءات الجزائية التي نص عليها القانون والمتمثلة بتحريك الدعوى في جرائم العنف الأسري، والمحكمة المختصة بنظرها، وإجراءات التحقيق والمحاكمة.
