من المعروف أن رئيس الدولة في لبنان، إضافة إلى كونه رئيس دولة في نظام برلمان، هو رئيس دولة يقوم نظامها البرلماني على المشاركة الطوائفية للسلطة، فهي ينتمي إلى طائفة معنية وفقاً للعرف الدستوري المعتمد منذ العام 1943 ويدخل موقعه في النظام السياسي في إطار التوازنات الطائفية التي تقوم عليها صيغة الحكم.
في هذه الدراسة يثير الدكتور عمر محمد شحادة السؤال الآتي: أيهما أكثر تأثيراً في وضع رئيس الدولة اللبناني، السمة الطائفية أم السمة البرلمانية، إن السمة الطائفية تؤثر في كيفية اختياره والسمة البرلمانية تؤثر في كيفية ممارسته لصلاحياته، يعني ما حدث – برأي المؤلف – هو جمع بين الطائفية السياسية والنظام البرلماني. فالسمة الطائفية للنظام هو عامل ثابت منذ استقلاله، كون الرئيس مارونياً لم يتغير، إنما الذي يتغير هو علاقة الرئيس بمجلس الوزراء. ومن هنا يبني المؤلف إشكالية العلاقة بين موقع رئيس الدولة في النظام البرلماني وموقع رئيس الدولة في الصيغة الطوائفية التي يقوم عليها النظام، وهي إشكالية على ما سوف يتضح – في الكتاب – مرتبطة بإشكالية العلاقة بين النظام البرلماني ونظام المشاركة الطوائفية في لبنان.
إن دراسة هذه الإشكالية والأسئلة المرتبطة بها، يجيب عنها المؤلف في ضوء التجربة التي مر بها النظام اللبناني منذ اتفاق الطائف وإلى اليوم في إشارة إلى الشلل الذي يصيب المؤسسات الدستورية، والتي تؤدي إلى فراغ في سدة رئاسة الجمهورية لمدة معلومة ...
يتألف الكتاب من ثلاثة فصول رئيسية جاءت تحت العناوين الآتية: الفصل الأول: صلاحيات رئيس الجمهورية في دستور عام 1926 (قبل الطائف)، الفصل الثاني: صلاحيات رئيس الجمهورية وفقاً لتعديلات عام 1990 (بعد الطائف) ، الفصل الثالث: صلاحيات رئيس الدولة في بعض النصوص الدستورية.
