هل حقق الخلع اهدافة ؟ هذا سؤال محورى وهام ويتعين للاجابة عنه أن نستعرض مرة اخرى فلسفة هذا القانون والحكمة من وضعة وما حاول أن يتلافاه من مشكلات كانت موضوع معاناة شديدة من قبل ويهدف هذا القانون الى ما يلى : سرعة حل المنازعات واختصار زمن الاشتباكات بين الازواج والزوجات. التاكيد على تحقيق رغبة كلا الزوجين فى استمرار الحياة الزوجية بينهما من دون ضغط أو كراهية أى طرف . اعتبار حالة البعض والكراهية سببا كافيا لانها العلاقة الزوجية . السعى بكل الطرق لاصلاح العلاقة بين الزوجين حماية وحفاظا على كيان الاسرة وفى حالة وجود أبناء يتم عرض الصلح مرتين على الاقل . لايصلح أن يكون مقابل الخلع إسقاط حضانة الصغار أو أى حق من حقوقهم . يقع الخلع طلاقا بائنا غير قابل للطعن عليه بأى طريق من طرق العن . الاجراء الوحيد فى الخلع هو أن ترد الزوجة مقدم الصداق ( المهر ) وهى غير مطالبة برد أى شئ آخر وينص القانون على تنازل المرأة عن حقوقها المالية الشرعية وهى النفقى ومؤخر الصداق .
