ضماناً لاستقلال أعضاء البرلمان وحماية لهم ضد أنواع التهديد والانتقام سواء من جانب السلطات الأخرى في المجتمع أم من جانب الأفراد تتضمن دساتير معظم دول العالم المتمدنة نصوصاً تكفل لهم الطمأنينة التامة والثقة الكاملة عند مباشرة أعمالهم النيابية.
هذه النصوص تجسد ما يعرف باسم "الحصانة البرلمانية" سواء أكانت موضوعية أم إجرائية تمثل استثناء من القانون العام، اقتضته ضرورة جعل السلطة التشريعية -الممثل الحقيقى للأمة- بمنأى عن اعتداءات السلطات الأخرى وطغيانها، وهي وإن كانت في ظاهرها تخل بمبدأ المساواة بين الأفراد، إلا أن عدم المساواة هنا لم يقرر لمصلحة النائب بل لمصلحة سلطة الأمة ولحفظ كيان التمثيل النيابي وصيانته ضد كل اعتداء.
ولكن ليس معنى ذلك أن يصبح أعضاء البرلمان -دونا عن بغية الأفراد- فوق القانون لا حسيب عليهم... فالحصانة في الواقع ليست طليقة في كل قيد أو حدّ، لا بل هناك ضوابط وقيود عديدة تحد من نطاقها وتمنع من غلوائها إذا ما تجاوز عضو البرلمان الحدود المسوح بها.
هدا ورغم أهمية موضوع الحصانة البرلمانية على هذا النحو، ورغم أنه موضوع قدم وثيقة قانون الحقوق في إنجلترا Bill of Rights وقدم إعلان حقوق الإنسان في فرنسا، رغم ذلك إلا أ،ه يكاد أن يكون من المواصفات التي لم تطرق بشكل جدي أو بشكل متعمق من جانب رجال الفقه السياسي أو الدستوري، من هنا كانت أهمية هذا البحث الذي بين يدينا والذي يختص ببيان المفهوم العلمي الصحيح للحصانة البرلمانية أولاً، ثم التطور التاريخى لهذه الحصانة بعد ذلك، ثم الطبيعة القانونية أو التكيف القانوني للحصانة البرلمانية، وأخيراً يتناول التطبيقات العملية لهذه الحصانة سواء في ذلك الحصانة ضد المسؤولية البرلمانية، أم الحصانة ضد الإجراءات الجنائية.
