لأن الحادث ينطوى على جزء من الصدفة ولا يسعى إليه، وقد عالج المشرع المصرى البحرى الحوادث البحرية فى الباب الرابع من ق 8 لسنة 1990 قانون التجارة البحرية المصرى الجديد وخصص لها المواد من (339-292) ونظم هذا الموضوع فى ثلاثة فصول، الفصل الأول: التصادم، الفصل الثانى: الإنقاذ، الفصل الثالث: الخسارات البحرية المشتركة، ويؤخذ على المشرع انه لم يعالج موضوع جنوح السفن وشحطها على الرغم من اهميته وتكرار وقوعه.
وفى دراستنا لهذا البحث الخاص بالمخاطر البحرية او الحوادث البحرية، نخصص الفصل الأول منه لدراسة التصادم البحرى من حيث ماهيته واحكامه ودعوى التصادم الخاص به، ثم نعرض فى الفصل الثانى من ذات البحث للإنقاذ البحرى من ناحية تعريفه وشروطه واحكام الإلتزام بالإنقاذ فيما يخص الإلتزام بالإنقاذ فى حالة التصادم والإلتزام بالإنقاذ بالنسبة للأشخاص، وكذلك نعرض لمكافأة الإنقاذ وحالات استحقاقها وتحديدها وتوزيعها، ووضع الإنقاذ البحرى فى القانون الدولى والتشريعات الوطنية، أما عن الفصل الثالث فنخصصه للخسارات البحرية المشتركة والأساس القانونى لنظرية الخسارات البحرية المشتركة وأنواعها ثم نعرض لشروط هذه الخسارات، والفصل الرابع ستكون دراسته عن الشحط والجنوح، ونخصص الفصل الخامس للنوع الخامس من أنواع الحوادث التى من الوارد أن تتعرض لها السفينة، ألا وهو الحريق، أما عن الفصل السادس والأخير فنخصصه لذكر نبذة صغيرة عن الحطام كنوع من أنواع الحوادث البحرية.
