من وجوه تكريم الإسلام للمرأة أنه أتاح لها المشاركة في اختيار شريك حياتها، دون إكراه، وفي الوقت ذاته شرع الولاية في النكاح، وجعلها من الأسس التي يقوم عليها العقد، وقد اعتبره بعض الفقهاء ركناً أو شرط صحة، لأن الزواج سبيل لتكوين أسرة جديدة، تكون لبنة في بناء المجتمع، فلا بد أن تقوم على أساس سليم، وأن يكون ولي له من حبه وعطفه، ومن خبرته وتجاربه وبعد نظره، ما يجعله أهلاً لأن يقوم بهذا الدور، لهذا الدور، لهذا كانت الولاية بهذه المثابة!
ومعلوم أن البكر البالغة التي لا خبرة لها في الحياة، لشدة خفرها وحيائها، وعدم تجاربها واختلاطها بالرجال، يغلب جانب العاطفة على جانب العقل عندها، ومع هذا لم يهمل الإسلام رأيها!
وهنا نبصر حماية للقاصرين في أفكارهم، أو في عقولهم، أو في عواطفهم.. سواء من الذين تقصر عقولهم وإدراكاتهم عن فهم الحياة، وما يفيدهم وما ينفعهم، أو المجانين والمعاتيه الذين فقدوا عقولهم، ولا يدرون من أمور الحياة شيئاً، ولا يعرفون ما يضرهم وما يصلح بالهم!
وفي ظل هذه الحماية يستقيم الشعور والتفكير، ويطمئن القلب والضمير، وقد حفل الدين القيم بالأدلة التي رسمت معالم تلك الولاية، وأنواعها، والأحكام المتعلقة بها، وهل تستقل المرأة بالعقد، ومن ثبتت عليهم ولاية الإجبار، وحكم استئذان البكر وكيفيته، وبم يكون، وماذا لو تعنت الأولياء فاتبعوا أسلوب العضل، وغير ذلك من كل ما يحيط عقد النكاح بالأسس السليمة!
ومن ثم كانت هذه الدراسة ضرورية، وفق منهج الدين القيم، حتى يتم الزواج في إطار سليم، تقوم معه الأسرة الطيبة، وتنشأ في ظله الأسرة الصالحةََ!
وقد اقتضت منهجية البحث أن يشتمل على الفصول التالية: الفصل الأول: أسباب الولاية في النكاح وأحكامها. الفصل الثاني: أنواع ولاية التزويج بالنسبة للمولى عليه. الفصل الثالث: من تثبت عليه ولاية المشاركة. الفصل الرابع: الرضا بالنطق ومن ثبتت له ولاية الإجبار. الفصل الخامس: حكم العضل وانتهاء الولاية.
