Book Description
وقف الإسلام من جريمة الزنى موقفاً حاسماً، واعتبرها من أبشع الجرائم، وأشدها نكراً، وأكبرها مقتاً عند الله عز وجل، وعبر عنها القرآن الكريم بالفاحشة، ومن ثم سن لها عقوبة صارمة ينزلها ولي المر بمن ثبت زناه ثبوتاً شرعياً، واعتبرها حداً من حدود الله، لكي يحمي نظام الأسرة والأنساب، ويقف حائلاً دون الإباحية الجنسية، وما تجره من ويلات على الفرد والأسرة والمجتمع.
وكان لنا في الماضي دولة إسلامية، استمر وجودها إلى أوائل القرن الرابع عشر، وكان للدولة جيش يذود عن حماها، وكان قانونها شريعة الإسلام!
بيد أن المسلمين قد حكموا في معظم بلادهم بغير ما أنزل الله، وبخاصة بعد أن وقعوا في قبضة الاستعمار! ثم ينادى المصلحون بالعودة إلى كتاب الله تعالى وسنة رسول الله صلى الله عليه وسلم، إلا أن دعواتهم قوبلت لدى الكثيرين باعتراضات!
ومنها ما كان من تقصير من الفقهاء ورجال القانون، في تيسير الحكم بما أنزل الله، عن طريق صياغة العقوبات، وعرضها في صورة قانونية، يسهل تطبيقها على المجتمعات والشعوب الإسلامية!
وعقوبة الزاني المحصن هي الرجم، وقد تضافرت الأدلة على ذلك، وانعقد الإجماع، باستثناء الخوارج، ومن على شاكلتهم، ممن أنكروا تلك العقوبة!
ومن ثم كانت هذه الدراسة ضرورية للرد على هؤلاء وأولئك، وتفنيد شبههم، والرد على ما ذهب إليه علمان من أعلام الشريعة المعاصرة في شأن عقوبة الرجم.
وقد اقتضت منهجية البحث أن يشتمل على ثلاثة فصول: الفصل الأول: حد الزنى وتدرجه. الفصل الثاني: الرجم وأدلته. الفصل الثالث: دفاع عن حد الرجم.
