تقوم هذه الرّسالة على البحث في موضوع الولاية في النّكاح في الشّريعة الإسلاميّة، وهو موضوع بالغ الأهميّة في الإسلام، إذ بعقد الزّواج تنشأ الأسر وتحفظ الأنساب.
وقد جاءت هذه الرّسالة في مقدّمة ومبحث تمهيدي وسبعة فصول وخاتمة، ففي المقدمة عرض المؤلف لأهمية الموضوع، وأسباب إختياره له، وفي البحث التمهيدي بيّن المقصود من الولاية وأنواعها، ومعنى النّكاح وحكمه، ثم العلاقة بينه وبين الولاية، ثم مشروعيّة الولاية في النّكاح، وقمت بالرّد على بعض الشبّهات التي تثار على الولاية.
وفي الفصل الأول تحدث عن أسباب الولاية في النّكاح، ثمّ في الفصل الثّاني عن الحرّة المكلّفة في النّكاح، وهذا الفصل من أهمّ فصول الرّسالة، لأنّه يجيب عن السّؤال المهم: هل ينعقد النّكاح بعبارة النّساء؟، والفصل الثالث تحدث عن ثبوت الولاية على الصغار في النّكاح، وهل يشترط في الصغيرة أن تكون بكراً؟ وفي الفصل الرابع بحث مسألة الولاية على فاقد الأهلية وهو "المجنون في هذا المبحث".
وأما الفصل الخامس فكان في الولاية على ناقص الأهليّة في النّكاح "السفيه" مال السّفيه، وفي الفصل السادس: تكلّم عن الوليّ من حيث: تعريفه، وشروطه، وحقوقه، وواجباته، وأما الفصل السابع: فكان عن موضوع مهمّ ومعاصر وهو النّكاح العرفي، فوضّح المقصود منه، ونشأته، وصوره، وأسباب إنتشاره، وطرق الوقاية منه، والحكم الشّرعي له.
وتضمّنت الرسالة موقف قانون الأحوال الشخصيّة الأردنيّ من جزئيّات موضوع الولاية في النّكاح في الشّريعة الإسلامية.
