تنبع أهمية البحث من أن التحقيق في الجرائم المعلوماتية من أهم الإجراءات التي تتخذ في الدعوى, إن لم يكن أهمها على الإطلاق, ومن ثم فإن المحقق يجب أن يتبصر ببعض الأمور التي جيب أن ينتبه لها أثناء التحقيق في هذا النوع من الجرائم, سيما وأن هذا الموضوع يتسم بالحداثة وبقلة المراجع التي يمكن الاعتماد عليها, ومن فقد حاولنا في هذه الدراسة بحث المشكلات القانونية المتعلقة بالتحقيق في الجرائم المعلوماتية ومحاولة الوصول إلى إيجاد الحلول المناسبة لها.
وسيكون قوام هذه الدراسة نصوص قوانين مكافحة الجرائم المعلوماتية في التشريعات المقارنة, وقانون الإجراءات الجنائية, وما تضمنته التعليمات العامة للنيابات من إرشادات, قصد بها أن تكون عوناً للمحقق في أداء واجبه على أكمل وجه.
لذلك سنقسم هذه الدراسة إلى ثلاث أبواب على النحو التالي: التحقيق الجنائي في البيئة الإلكترونية, إجراءات التحقيق في الجرائم المعلوماتية, التحقيق في جرائم المعلوماتية الواقعة على الأشخاص والأموال, وستختتم الدراسة بخاتمة تنطوي على نتائج الدراسة وتوصياتها.
