تمثل الجريمة منذ نشوء البشرية، مشكلة بالغة الخطورة، دون أن توفر لها العقوبة إلا حلاً جزئياً مؤقتاً، لأنها في واقع الحال ظاهرة إنسانية وإجتماعية ناشئة عن التفاعلات الحادة للأمزجة الشخصية المتباينة والمصالح المتعارضة، من وهنا وجب البحث عن سياسة تتولى تطهير المجتمع من ذوي الميول الإجرامية وهذه السياسة تتولى تخطيطها "سياسة جنائية"، لمنع ارتكاب الجرائم، ومعاقبة مرتكبيها على النحو الذي يؤدي إلى إصلاحهم أو عزلهم عن المجتمع إن تعذر إصلاحهم، لحمايتهم من شرور إجرامهم. وعلى هذا تكون السياسة الجنائية مجموعة الوسائل التي يمكن اتخاذها في وقت معين وفي بلد معين من أجل مكافحة الإجرام. وبما أن السياسة الجنائية تخضع باستمرار للمؤثرات النابعة عن اختلاف الأجناس والأديان والمعتقدات ونحو ذلك، فهذا يعني تعدد أنماطها، وتباينه موضوعاً وشكلاً، تبعاً لاختلاف المكان والزمان، ولما يسود فيها من ظروف وأحوال. ويبرز التعدد في كل من شطري هذه السياسة، وهما "سياسة التجريم" و "سياسة العقاب" اللتين يتناولهما هذا الكتاب على التعاقب في البابين الأول والثاني بعد فصل تمهيدي عن "سياسة الوقاية من الإجرام" وتأتي في محورين: الأول: الرعاية المتكاملة للأفراد، والثاني: تأمين الضبط الإجتماعي. وأما (الباب الأول) فجاء في "سياسة التجريم" ويضم: الفصل الأول: سياسة التجريم من حيث الموضوع، والفصل الثاني: سياسة التجريم من حيث الشكل. وأما (الباب الثاني) فجاء في "سياسة العقاب" ويضم: الفصل الأول: نشأة العقوبة وتطور سياسة العقاب قديماً، والفصل الثاني: تطور سياسة العقاب حديثاً. وأخيراً الفصل الثالث: سياسة العقاب المعاصرة .. التغريد التشريعي للعقاب، والتغريد التنفيذي للعقاب.
