تعد عقود الإنشاءات من أهم مجالات الإنفاق في الوقت الراهن، نتيجة للإزدياد المتصاعد في عدد السكان والذي استتبعه كنتيجة منطقية إزدياد الطلب على المشاريع العمرانية، سواء أكان ذلك لأغراض السكني أم للأغراض الصناعية والتجارية، وهذا الإزدياد في الطلب اصطدم بمشكلة التمويل لما تتطلبه تلك المشاريع العمرانية من رؤوس أموال ضخمة.
وقد انعكست هذه المشكلة على الصيغ التعاقدية لتنفيذ تلك المشاريع، وأفرزت الساحة العمرانية صيغاً جديدة للتعاقد تحظى بأهمية بالغة لما تؤديه من وظائف تمويلية لم تحظ بها العقود التقليدية وكانت إحدى هذه الصيغ هي عقد الإنشاءات مقابل حصة من العقار.
يتكون هذا الكتاب من ثلاثة فصول، يبحث الفصل الأول في التعريف بعقد الإنشاءات مقابل حصة من العقار وماهيته عن طريق تعريفه وبيان أنواع هذا العقد والشكلية فيه والنتائج المترتبة عن الإخلال بالشكلية في هذا العقد ومدى إمكانية تسجيل عقد الإنشاءات مقابل حصة من العقار في القانون العراقي، كما يبحث في خصائص هذا العقد والتكييف القانوني له.
أما الفصل الثاني؛ فقد خصص لبحث آثار عقد الإنشاءات مقابل حصة من العقار، من خلال عرض أهم الإلتزامات الملقاة على عاتق المتعهد والعلاقات التي ينشئها مع الفئات التي تتولى معه تنفيذ عقد الإنشاءات مقابل حصة من العقار، كما يبين الإلتزامات الملقاة على عاتق مالك العقار، وطرائق دفع المسؤولية التي يلجأ إليها الأطراف في حال تحققت مسؤوليتهم بسبب إخلالهم بإحدى إلتزاماتهم.
وأخيراً، يبحث الفصل الثالث في الضمانات في عقد الإنشاءات مقابل حصة من العقار والتي تشمل الضمانات القانونية، إضافةً إلى الضمانات الإتفاقية التي يمكن أن يلجأ إليها أطراف العقد في حال عجزت الضمانات القانونية عن ضمان حقوق الطرفين، كما يبين طرائق إنقضاء عقد الإنشاءات مقابل حصة من العقار.
