لا شك أن مصالح الدولة الأساسية هى محط أنظار المشرع وهدفه؛ لأن حماية هذه المصالح تهدف إلى تحقيق التقدم والرقى من ناحية، وتأمين هذه المصالح من ناحية أخرى؛ لذلك يسعى المشرع إلى حماية هذه المصالح من مصادر الاعتداء المختلفة، سواء كانت داخلية أو خارجية. وهذه المصالح تمثل القيم الإجتماعية العليا للمجتمع، ويسعى المشرع إلى حمايتها بالتشريعات المختلفة، وأهمها قانون العقوبات. ولهذا حاول الباحث الوقوف على هذه المصالح؛ لتحديد محل الإعتداء، وخطة المشرع فى مواجهة هذا الإعتداء، وإلى أى مدى تحققت هذه الحماية الجنائية المستهدفة. والمشرع فى تنظيمه لجرائم أمن الدولة، تعرض للحريات بقيود تقتضيها مصلحة المجتمع، وخرج عن القواعد العامة فى قانون العقوبات وقانون الإجراءات الجنائية؛ لحماية مصالح الدولة الأساسية. وما ورد فى القواعد العامة ليس كافياً لتوفير هذه الحماية.
