ان القوانين الوضعية من صنع الانسان . ولاشك ان الاخير يبقى قاصراً عن الاحاطة بكل الامور مهما بلغ من الفطنة والادراك . ويترتب على ذلك ان صنع الانسان يبقى متسم بالقصور وعدم الكمال . وكلما مضى الزمن على هذا العمل ادرك الانسان عيوبه وعدم دقته . والقوانين الوضعية ومنها القوانين العقابية باعتبارها من صنع الانسان لا تخرج عن القاعدة المذكورة فهي عادة ما تتسم بالقصور نتيجة لقصور ادراك واضعيها . فقد يحاول المشرع جاهداً وقت وضع النص الالمام بكل التفاصيل ومعالجة اصغر الجزيئات لكن سرعان ما تنكشف العيوب خلال التطبيق العملي . فيحاول المشرع ان يعالج ذلك ببعض التعديلات وبعد مدة يكتشف ان التعديلات قاصرة
