لقد كتب الكثير في موضوع الطفل، من حيث تربيته ورعايته ومراحل عمره... أما البحث في مسألة الإلتزام بضمان السلامة وتطبيقاته في العقود، فقليل، ولانه كذلك قامت الباحثة نرمين أبو بكر محمد بوضع دراسة رائعة عن الإلتزام بضمان السلامة في عقد الحضانة فأوضحت أركانه وتناولت أحكام الإلتزام بضمان السلامة بصورة عامة، ثم بينت أحكام الإخلال بهذا الإلتزام في هذا العقد المهم. وقد خرجت الباحثة بخاتمة مهمة تضمنت استنتاجات وتوصيات من المفيد جداً على الجهات المعنية الأخذ بها.
يبقى أن نشير، أن هذه الدراسة الخاصة بـ (الإلتزام بضمان السلامة في عقد الحضانة) تتناول نظام دور الحضانة بالعراق ومنها: "نظام دور الحضانة رقم (1) لسنة 1992م المعمول به حالياً في العراق، وهناك نظام دور الحضانة رقم (42) لسنة 1977م، ونظام دور الحضانة رقم (12) لسنة 1965 الملغيين بنظام دور الحضانة رقم (1) لسنة 1992". وقد اتبعت الدراسة (المنهج المقارن) لمقارنة بين القانون المدني العراقي من جهة، والقوانين المدنية في كل من مصر والأردن، من جهة أخرى، وتطرقت إلى قانون العمل الخاصة بحقوق الطفل وقانون الرعاية الإجتماعية ونظام دور الحضانة وذلك لأهمية التطرق إليها في هذا المجال...
