نظراً لأن هذا البحث قد أفرد لفكرة الإلتزام بالسلامة فى عقد البيع، فإن من الطبعى ان نستبعد من نطاقه ما يقال له فى الإصطلاح "الضرر التجارى"، الذى يجرى تعويضه وفقاً للقواعد العامة فى ضمان العيوب الخفية، بحيث يقتصر هذا النطاق على الأضرار التى يحدثها المبيع بالمشترى، أو بغيره، فى النفس أو المال، والواقع أنه وان كان كل هذين النوعين ينشأ، عادة، من عيوب المبيع، إلا أن التمييز بينهما ليس بالأمر العسير، ذلك أن الضرر التجارى إنما يتمثل - كما هو معلوم - فى عدم صلاحية المبيع للغرض المخصص له أو فى نقصان فائدته.
أما الضرر الذى يحدثه المبيع فهو ذلك الذى يترتب مباشرة على ذات العيب، او على ما ينطوى عليه المبيع من خطورة ذاتية، وهو يتمثل، عادة، فى خسارة حاقت بالنفس او المال، حيث يثور التساؤل -عندئذ- عما إذا كان البائع يلتزم بتعويض هذا الضرر، وعن مضمون هذا الإلتزام إن وجد، وعن الأساس الذى يستند إليه، والآثار المترتبة عليه، وهى الأسئلة التى سنحاول الإجابة عليها من خلال هذه الدراسة.
بديهى أن نستهل دراستنا، فى هذا البحث، بتحديد مضمون الإلتزام بالسلامة، وبيان الأساس الذى يقوم عليه، حتى إذا ما فرغنا من ذلك، كان علينا أن نعرض لآثار هذا الإلتزام، حيث نعالج دعوى المسئولية سواء من حيث طبيعتها ومداها، ام من حيث مدى إمكان الإتفاق على تعديل أحكامها، ووسائل دفعها، وسوف نخصص لكل من هذين الموضوعين بابا مستقلاً، ولكن لما كان الإلتزام بالسلامة يرتهن فى قيامه بنشأة العقد، فإن هذا يفرض علينا أن نتصدى، أولاً، لتحديد اللحظة التى يتم فيها إبرام البيع، وهو ما نفرد له الفصل التمهيدى من هذا المؤلف.
