أمام قصور قضاء وقف التنفيذ في تحقيق العدالة الإدارية وتوفير حماية فعالة للحقوق والحريات الأساسية، فإننا سوف نتناول بالدراسة والبحث- بمشيئة الله تعالى- دور القضاء الإداري الفرنسي المستعجل في حماية الحريات الأساسية طبقاً للمادة 521 - 2 من تقنين القضاء الإداري الفرنسي وذلك من خلال بيان موقف المشرع الفرنسي والفقه والقضاء الفرنسي في شأن توفير حماية فعالة وسريعة للحقوق والحريات الأساسية في حالة الاعتداء عليها من جانب أحد أشخاص القانون العام، أو أحد اشخاص القانون الخاص الذي يتولى إدارة مرفق عام، أثناء ممارسة سلطاته، مع المقارنة بنظام وقف التنفيذ في مصر للوقوف على مدى أهمية التطور الذي لحق بالقضاء الإداري الفرنسي في هذا الشأن ومدى إمكانية تطبيقه في مصر.
وبناء على ما تقدم فإننا سوف نتناول موضوع البحث من خلال فصل تمهيدي يتعلق بسلطة القاضي الإداري في توجيه أوامر لجهة الإدارة أو الحلول محلها والاستثناءات الواردة عليه، وفصل أول يتعلق بشروط قبول طلب إصدار أوامر لجهة الإدارة في حالة الاعتداء على الحريات الأساسية، وفصل ثان يتعلق بإجراءات تقديم طلب توجيه أمر للإدارة لحماية الحريات الأساسية والحكم فيه، وعلى ضوء ما تقدم يمكننا تقسيم دراسة هذا البحث إلى ثلاثة فصول على النحو التالي: الفصل التمهيدي: مبدأ حظر توجيه أوامر من القاضي الإداري للإدارة والاستثناءات الواردة عليه، الفصل الأول: الشروط الواجب توافرها لتقديم طلب لإصدار أوامر لجهة الإدارة في حالة الاعتداء على الحريات الأساسية، الفصل الثاني: إجراءات تقديم طلب توجيه أمر للإدارة لحماية الحريات الأساسية والحكم فيه.
