مما لاشك فيه أن التعرض لدراسة موضوع حرية القاضي الجنائي في تكوين عقيدته، أو بالأحرى مبدأ الإقتناع الذاتي للقاضي الجنائي، هو في حد ذاته محاولة دقيقة محفوفة بالصعاب، لأنها ليست مجرد شرح لهذا المبدأ والنصوص الواردة في التشريع بشأنه أو مجرد عرض له وإستظهار مدى ما يكتنفه من غموض أو قصور أو إستظهار لبعض أراء الفقه بشأنه، وإنما هي دراسة تأصيلية وتحليلية وإنتقادية وفي جوانب كثيرة منها تطبيقية، وقد حرص الباحث على دراسة موضوع البحث من الناحية النظرية الفلسفية للوقوف على جذوره التاريخية وتطوره، وذلك مقارنة مع التشريع الفرنسي، ووفقاً لما تقدم فإن دراستنا سوف تتناول موضوع حرية القاضي الجنائي في تكوين عقيدته في القانون الوضعي في مصر وفرنسا، وذلك من حيث عرض الأحكام العامة لمبدأ قضاء القاضي بمحض إقتناعه، وشروط صلاحيته، ونطاقه، وموقف الفقه والمشرع منه، وأدلة الإثبات التي أقرها القانون أو بالأحرى مصادر الإقتناع القضائي، ثم بيان الشروط الموضوعية المتطلبة في كل دليل، واستظهار قيمته ومدى سلطة القاضي في تقديره، وأيضاً بيان جهة الرقابة على محكمة الموضوع من خلال تسبيب الأحكام الجنائية ورقابة محكمة النقض عليها- ثم نعقب ذلك بخاتمة تتضمن ما توصلنا إليه من مقترحات.
