نتناول في هذا البحث مقتضيات المصلحة العامة في وجهي النظام القانوني للبراءات، وهما منح البراءات واستغلالها، حيث سيتم إبراز الضوابط القانونية الخاصة بمنح البراءات والمنصوص عليها في التشريعات العربية، وتحديد مدى أهميتها للمحافظة على المصلحة العامة في منع إصدار براءات للاختراعات التي تتعارض حمايتها مع مصالح الدولة الاقتصادية والعسكرية، وتنتهك الحقوق الوطنية في المواد الورائية والمعارف التقليدية، كما يتضمن البحث توضيح أهمية استغلال براءات الاختراع داخل الحدود الإقليمية للدول العربية.
ومما تقدم تكون خطة البحث كالتالي: الباب الأول: مقتضيات المصلحة العامة بشأن منح براءات الاختراع (الفصل الأول تحديد المصلحة العامة في ظل المنظومة القانونية الدولية والتشريعات العربية لبراءات الاختراع، الفصل الثاني ضوابط تحقيق المصلحة العامة عند منح براءات الاختراع في التشريعات العربية)
