إذا كان القانون الإداري يهتم بدراسة الدولة والأشخاص المعنوية العامة الأخرى بحسبانها كل الأشخاص القانونية في مجاله، إلا أن الشخص المعنوي العام لا يستطيع بطبيعته أن يؤدى رسالته او الهدف منه إلا عن طريق شخص أدمي اى شخص طبيعي يكون المعبر عن إرادته وهذا الشخص يعرف بالموظف العام.
ولقد زاد دور الموظف العام بعد الأخذ بسياسة التدخل وتغير دور الدولة عن ذى قبل، فلم تعد وظيفة الدولة قاصرة عن الأمن الداخلي والدفاع عن الوطن والقضاء في المنازعات، بل إمتد حتى تغلغل في صميم النشاطات الخاصة وقامت الدولة بواسطة موظفيها بإدارة العديد من المرافق الاقتصادية وهو ما أدى إلى ان أصبح الموظف العام هو المسأة الرئيسية التى شغلت- ولا زالت- أذهان المفكرين سواء أكانوا من علماء الإدارة من فقهاء القانون العام أم من مصلحين إجتماعيين وهو ما يدعونا في هذا الكتابإلى إلقاء الضوء على النظام القانوني الذي يحكم الموظف العام باعتباره آداه الدولة في ممارسة سلطانها ومزاولة نشاطاتها وتحقيق أهدافها الممثلة في تحقيق الصالح العام.
