تقديراً لأهمية دور أفراد الخدمة المدنية الدولية فإنه يكون من الحرى تسليط الضوء على جانب مهم في علاقتهم القانونية مع جهة الإدارة في المنظمات التي يعملون لديها، هو ذلك المتعلق بالمنازعات التي قد تنشب بمناسبة علاقة الوظيفة العامة الدولية في إطار القواعد القانونية الحاكمة لسير الإدارة داخل هذه المنظمات، أو ما يعرف اصطلاحاً بــ(القانون الإداري الدولي)، وبالأخص تتركز هذه الدراسة حول حق هؤلاء في اللجوء إلى الآليات القضائية المعروفة في إطار هذا القانون وهي المحاكم الإدارية الدولية.
بيد أن الإشكالية لهذه الدراسة تتمثل بعدم إقرار هذه المنظمات لكافة الأفراد العاملين في خدمتها بحق اللجوء إلى جهات القضاء الإداري الدولي فيما يتعلق بتلك المنازعات، بل تحاول هذه المنظمات قصره على طائفة محدودة منهم دون الكافة، على نحو يصيب الأنظمة الحالية للوظيفة العامة الدولية بالقصور من حيث حصر الضمانات القضائية للوظيفة في جزء من العاملين وحرمان الآخرين، وهو ما لا ينسجم مع المنطق القانوني السليم الذي يقضي بأن الحق في التقاضي لا يقبل التجزئة، كما أن من الإشكاليات المرتبطة بهذا الموضوع إشكالية نهائية أحكام القضاء الإداري الدولي لافتقاره طريق الطعن بالاستئناف، وأيضاً الإشكالية المتعلقة بعدم تنفيذ هذه الأحكام.
وبذا تأتي أهمية هذه الدراسة من كونها تعمد إلى سير أغوار هذا الموضوع بمختلف جزئياته وتفصيلاته، وذلك بتتبع مراحل وخطوات النظام القانوني لحق الموظف الدولي في الحماية القضائية بداية بنشوء الخصومة الإدارية نتيجة إصدار جهة الإدارة في المنظمة الدولية قراراً يرى فيه الموظف المعني انتهاكاً لحقوقه المترتبة على علاقة العمل التي تربطه بهذه المنظمة، وانتهاء بإصدار الحكم القضائي النهائي في هذه الخصومة، وقد سعى الباحث جهده إلى إضفاء الطابع التطبيقي على هذه الدراسة، وذلك بالاستناد للتطبيقات القضائية.
