إن التعاون بين الدول المختلفة ضرورة يتطلبه التعايش بينها، وإزدادت الحاجة لهذا التعاون بحصول التطوّر في العالم بمختلف المجالات عند نشوء الدولة الحديثة، وخصوصاً التعاون في المجال القانوني والقضائي، الأمر الذي تطلب وجود قواعد تنظّم ذلك التعاون والعلاقات التي نشأت بين الدول.
إذاً فالتعاون الدولي ضرورة لا بد منه لخدمة العدالة الدولية في مجال الجرائم التي تعد ظاهرة مشتركة بين الدول والتي تؤثر على جميع دول العالم بما في ذلك الإستقرار السياسي والتنمية الإجتماعية والإقتصادية المستدامة فيها، ولذلك فإن التعاون الدولي ضرورة لمنع ومكافحة الجرائم.
ولعل أبرز أوجه التعاون الدولي والذي يجب تنميته وتفعيله بصورة إيجابية هو ذلك المتعلّق بالإنابة (الإستنابة) القضائية أو المساعدة القانونية المتبادلة، وليس خافياً أن هناك عقبات كثيرة وجمة تعترض الإنابات (الإستنابات) القضائية كونها تعد من أصعب أشكال التعاون القضائي الدولي في القضايا الجنائية وأكثرها أهمية.
ولأجل تسليط الضوء على فكرة الإنابة القضائية الجنائية الدولية بما يتناسب مع أهميتها العلمية والعملية بحث الكتاب في ماهيتها وموضوعها وشروط وإجراءات تطبيقها ومعوقات تنفيذها والآثار المترتبة عليها.
