من المعروف أن العقد يزول بانقضائه (extinction) أو بانحلاله (dissolution) أو بإبطاله (annulation) أو بفسخه (resiliation). كما وبتوافق فرقاء العقد على كل هذه الحالات فإنه تنتفي المسؤولية التعاقدية أمام رضى الجميع بإنهاء العقد ومفاعيله بحيث يكون الفرقاء إزاء حالة الإلغاء الرضائية أو بما يعرف "بوحدة المسؤولية" (Unite de responsabilite).
من ناحية أخرى، إن العقد شرعة المتعاقدين، فلا يجوز لمعاقد بإرادته المنفردة نقضه أو تعديله لأن ما تعقده إرادتان لا تحله إرادة واحدة وان يمنع على المعاقد إثباته منفردا يمنع على القاضي إجراؤه لأن وظيفته تطبيق العقد لا إنشاؤه.
لهذا حاول المؤلف في هذا الجزء التاسع من الموسوعة المدنية الحقوقية المختارة أن يفسر قانونية ومشروعية الفسخ الحكمي للعقود والإتفاقيات من خلال بعض العينات الإجتهادية أو الفقهية التي تناولت الموضوع بالإستناد إلى النصوص القانونية.
