لقد انتشر -في الواقع العملي -في كثير من دول العالم -ومنها مصر- ظاهرة امتناع بعض الجهات الإدارية عن تنفيذ أحكام القضاء، مادام الأمر يتوقف في النهاية علي حسن الإدارة.
فالإدارة مستندة إلي مركزها التنظيمي والإجرائي المميز تظهر سوء نيتها في حالات كثيرة، أو علي الأقل الرغبة في قهر الفرد الذي يقاضيها خاصة حيث تكون المنازعة القضائية امتداداً لمعارك شخصية أو خلافات سياسية. ويكاد يجمع فقهاء القانون الإداري علي أن مشكلة تنفيذ الإدارة للأحكام الصادرة ضدها من جهات القضاء الإداري تمثل نقطة الضعف في القانون الإداري مادام الأمر يتوقف في النهاية علي حسن نية الإدارة.
وقد شهدت أفرع القانون المختلفة في السنوات الأخيرة اهتماماً كبيراً بمشكلة تنفيذ الأحكام. وفي القانون الإداري بذل القضاء الإداري خلال مدة طويلة جهوداً كثيرة لتزويد رقابته علي أعمال الإدارة بعدة وسائل لحث الإدارة علي تنفيذ ما يصدره من أحكام في مواجهتها، وأحياناً الضغط عليها لحملها علي التنفيذ وذلك في محاولة منه للتلطيف من الحدود التقليدية المفروضة عليه تجاه الإدارة، بجانب الوسائل الجزائية التي قررها المشرع لمواجهة امتناع الإدارة عن تنفيذ الأحكام القضائية.
فهل نجحت هذه الوسائل في التغلب علي عناد الإدارة، بحملها علي تنفيذ ما يصدر ضدها من أحكام قضائية؟ هذا هو السؤال المحوري الذي يدور حول إجابته موضوع هذا البحث. ولتحديد نطاق البحث إن الأحكام القضائية التي كرسنا هذا البحث لدراسة وسائل ضمان تنفيذها هي تلك الأحكام الصادرة من القضاء الإداري في مواجهة الإدارة، والتي تفرض عليها القيام بالتزامات معينة لصالح المحكوم له.
ولهذا نستبعد من نطاق بحثنا الأحكام القضائية الأخري وإن كانت تفرض علي الإدارة التزامات معينة.
