إنّ من أكثر البدهيات شيوعاً بين المسلمين، أنّ شريعة الإسلام واضحة ليلها كنهارها، تسير على منهج واحد، لا إختلاف فيه ولا تضارب.
لكن هذه الحقيقة الواضحة سرعان ما تصطدم بواقع الخلاف الذي عليه العلماء المسلمون من عهد الصحابة إلى عصرنا الحاضر.
ووجود التعارض في القرآن الكريم والسنّة الشريفة يوهم إبتداءً بأنّه قد تسرب إليهما الخلل، وإعتراهما بعض ما يعتري النصوص البشرية من تناقض وإضطراب، يعودان إلى طبيعة النقص التي جبل عليها الإنسان.
إلاّ أنه عند التأمل يتبين أنّ هذا التعارض ليس صفة ذاتية للنصوص الشرعية، بل هو من الأعراض الظاهرية التي تلحق بها لأسباب عديدة.
وتعود أبرز هذه الأسباب إلى ذهن المجتهد لا إلى النصوص في ذاتها.
لكن هذا السبب يكمن وراءه سبب آخر، هو طبيعة النصوص الشرعية ذاتها، لا على معنى أنّها متناقضة بطبعها، وإنمّا على معنى أنّها ليست نصوصاً عادية كتلك التي يكتبها البشر لما فيها من إعجاز، وبلاغة نظم، وأساليب متنوعة الدلالة، تتطلب التعمق في البحث، وإختلاف التفاسير، وبهذا يسقط القول بأنّ التعارض منقصة تعيب القرآن الكريم والسنّة الشريفة، لأنّه في حقيقة الأمر يعتبر مزية ترفع قدرهما.
كل هذه المواضيع والإشكاليات تتناولها هذه الدراسة بالبحث والتحليل وإيضاح الإشكاليات.
