الخطف ظاهرة من الظواهر الإرهابية التي ليست بالجديدة، فقد وجدت أعمال العنف والقمع والخطف والاغتيال منذ القديم وفي أغلب المجتمعات ومارسها الأفراد كما مارستها فئات ومنظمات دولية ودول وقوى أخرى مختلفة.
وترتبط هذه الظاهرة عادة بالوضع العام للجريمة وأسبابها بوصفها نوعاً من الإجرام ولكنها اتسعت في الآونة الأخيرة كماً ونوعاً وبشكل ملفت للنظر وصارت لها فلسفتها وأدواتها وأهدافها بحيث أخذت تأخذ أثاراً خطيرة على الاوضاع المحليه والدولية لما تميزت به من استخدام أساليب ووسائل مختلفة حتى غدت ظاهره تثير القلق. وقد استقطبت هذه الظاهرة الاهتمام الداخلي للدول حيث اضطر المشرعون في الكثيرمن الدول إلى إصدار قوانين خاصة لجرائم الإرهاب ومنها جريمة الخطف، والى إنشاء محاكم خاصة لمحاكمة مرتكبي هذه الجرائم والعراق من الدول التي سارت في هذا الاتجاه، وذلك بإصدار القانون رقم (13) لسنة 2005 (قانون مكافحة الإرهاب) وإنشاء المحاكم الجنائية المركزية.
وعلى المستوى الدولي فقد انظم العراق إلى اتفاقية الأمم المتحدة لمكافحة الجريمة المنظمه والبروتوكولين الملحقين بها وذلك بالقانون رقم (20) لسنة 2007، كما تم التصديق على الإتفاقية العربية لمكافحة الإرهاب وتعديلها بالقانون رقم 35 لسنة 2008 وذلك بعد أن غدا الإرهاب جريمة منظمه عابره للحدود، وهذا الاهتمام المتزايد الداخلي والدولي لظاهرة الإرهاب عموماً ولجرائم الخطف خصوصاً هو مادفعني إلى الكتابه في هذا الموضوع.
أية دراسة علمية تحتاج الى جهد كبير من العمل المتواصل، واجتهاد ومثابرة لكي تكلل بالنجاح وتزال العقبات لكي نصل الى مستوى الطموح المنشود، وتتخللها صعوبات، وإن من اهم الصعوبات التي واجهتنا اثناء الكتابة هي ندرة المصادر الحديثة التي تخص هذه الدراسة.
