ممّا لا شك فيه أنّ الإرهاب أصبح ظاهرة خطيرة تهدد الحياة اليومية للإنسان في أي مكان في العالم، وتتجلى تلك الخطورة في مساس الأفعال الإرهابية بمن ليس له علاقة بالإتجاهات السياسية أو الدينية أو الثقافية وبغض النظر عن الإنتماءات والتوجهات العرقية أو المذهبية، التي يسعى الإرهاب إلى تعميقها وتحقيقها بتلك الأفعال، حتى إزدادت المخاوف وتضاعفت لدى الشعوب والدول والمنظمات الدولية من الإرهاب، نتيجة لما يتولد عنه من الإحساس بعدم الأمن والإطمئنان، ولما يثيره من خوف ورعب وفزع في النفوس، وخاصة بعد إنتشار العمليات الإرهابية على نطاق واسع في الآونة الاخيرة، وحيث أنّ الخوف من الظاهرة يؤدي إلى محاولة تجنبها ومكافحتها.
لذا حاولت الدول ومنها العراق سواء على المستوى المحلي أو على المستوى الدولي، إلى وضع القواعد الموضوعية والإجرائية لمواجهة تلك الظاهرة التي بدأت تتصاعد يوماً بعد يوم في كلّ المجتمعات؛ لذا يتبنى المشرّع العراقي في معالجة الجريمة الإرهابية معالجة موضوعية شاملة، الإتجاه المؤيّد لإصدار قانون خاص ومستقل لمعالجة الجريمة الإرهابية، فأصدر المشرّع قانون مكافحة الإرهاب رقم 13 لسنة 2005.
ونظراً لأهمية موضوع الجريمة الإرهابية، بحثه الدكتور حيدر علي نوري في دراسته هذه في ضوء قانون مكافحة الإرهاب، وقد اقتضى البحث تقسيمه إلى مبحث تمهيدي وبابين وهما كما يأتي: المبحث التمهيدي: التأصيل التاريخي للجريمة الإرهابية، حيث بيّن فيه المؤلف الإرهاب والجريمة الإرهابية في المجتمعات القديمة والعصور الوسطى والعصر الحديث؛ الباب الأول: البنيان القانوني للجريمة الإرهابية، حيث وضح فيه ماهية الجريمة الإرهابية، ثم بين أركان الجريمة الإرهابية وصورها؛ أما الباب الثاني: نماذج الجريمة الإرهابية حيث بين فيه الجرائم الإرهابية البحتة (العامة)، والجرائم الإرهابية الملحقة (الخاصة).
