يمثل التشريع حجر الزاوية في بناء المجتمعات الإنسانية، ويعد الركيزة الأساسية لمواكبة التطور، فالقانون بمفهومه العصري هو نتاج المؤسسات المدنية الحديثة، إذ تمتد جذوره عميقاً في عادات وتقاليد الشعوب، وفي البنى الثقافية والاخلاقية والإجتماعية، وهو تراث يرتكز على خصوصية الدولة وذاتيتها الثقافية والحضارية ويجسده غالباً ممثلو الأمة الذين تنحصر فيهم مهام السلطة التشريعية.
ويقوم النظام النيابي على مبدأ الفصل بين السلطات وخاصة بين السلطتين التشريعية والتنفيذية، غير أن هذا الفصل ليس معناه إقامة حاجز يفصل فصلاً تاماً بين السلطات، بل يكون بين هذه السلطات تعاون أو تداخل، كما يكون لكل منها نوعاً من الرقابة على الأخرى في نطاق إختصاصها، ومن أوجه التعاون بين السلطات عملية التشريع التي لم تعد قاصرة على السلطة التشريعية دون التنفيذية بل أصبحت عملية مشتركة بين السلطتين التشريعية والتنفيذية وخاصة فيما يتعلق بمرحلة تقديم مشروعات القوانين، إذ تلعب السلطة التنفيذية دوراً فعالاً وأساسياً في هذه المرحلة بالذات إلى جانب مراحل العملية التشريعية الاخرى.
