يبحث موضوع هذا المؤلف في الحماية القانونية في مرحلة التحقيق الابتدائي.
ويقصد بالقانون في هذا الصدد كل قاعدة قانونية وفقاً لتدرجها في النظام القانوني السائد، ويأتي الدستور بوصفه القانون الأسمى على رأس هذا النظام القانونى وبه تلتزم جميع سلطات الدولة والأفراد، فالسلطة التشريعية تلتزم بالدستور فيما تسنه من تشريعات، والسلطة التنفيذية تلتزم بالدستور والتشريع فيما يصدر عنها من لوائح، ويقع علي عاتق الأفراد احترام القانون أياً كان مصدره وقيمته بين هذه القواعد القانونية.
ونظراً للعلاقة الوثيقة بين الدستور والقانون الجنائي عنينا ببحث الحماية القانونية للمتهم في مرحلة التحقيق من خلال فصل تمهيدي نتناول فيه ضمانات المتهم في نصوص الدستور، ثم نفرد بابين آخرين لهذه الحماية في قانون العقوبات وقانون الإجراءات الجنائية.
ويتطرق البحث في هذا النطاق إلى تحديد التوازن بين الحقوق والحريات مع غيرها من القيم الدستورية متمثلة في الحقوق والحريات والمصلحة العامة وإلي ضمان فاعليتها من خلال الرقابة القضائية على دستورية القوانين.
ومن هذه الدراسة يتجلى أثر الحماية الدستورية للحقوق والحريات في نصوص القانون الجنائي أكثر من غيره من فروع القانون، ولعل سبب ذلك يرجع إلى ما سبق أن ذكرناه من تهديد حريات الأفراد وحياتهم للخطر، مما يتطلب ضرورة التدخل لحمايتها بهدف حماية المصلحة الاجتماعية، وإقرار سلطة الدولة في العقاب وبواسطة الضمانات التي يقررها لهذه الحقوق والحريات.
