ينص ميثاق الأمم المتحدة في أكثر من موضع على ضرورة حل الخلافات الدولية بالطرق السلمية، من ذلك جاء في المادة الأولى فقرة (أ) من الميثاق، وذلك أيضاً ما جاء في الفقرة الثالثة من المادة الثانية من النص على أن "يفض جميع أعضاء الهيئة منازعاتهم الدولية بالوسائل السلمية على وجه لا يجعل السلم والأمن والعدل الدولي عرضة للخطر" ومن ذلك أيضاً ما جاء في المادة الثالثة والثلاثين من ميثاق الأمم المتحدة الخاصة بحل المنازعات حلاً سلمياً من أنه "1- يجب على أطراف أي نزاع من شأن استمراه أن يعرض حفظ السلم والأمن الدولي للخطر أن يلتمسوا حله بادئ ذي بدء بطريق المفاوضة والتحقيق والوساطة والتوفيق والتحكيم والتسوية القضائية، أو يلجأ إلى الوكالات والتنظيمات الإقليمية وغيرها من الوسائل السلمية التي يقع عليها اختيارها"، ويدخل في دراسة وسائل حل المنازعات الدولية التعرض بالدراسة للحرب، حيث كانت- في القانون الدولي العام التقليدي- تعد من وسائل حل المنازعات الدولية، ومن بين الأساليب التنفيذية في القانون الدولي العام. ومن الضروري أن نلقي نظرة سريعة على مدى تأثر هذه الوسيلة في ظل التنظيم الدولي، ثم تدرس بالتفصيل الدور الذي تقوم به معاهدات الصلح في إنهاء الحرب مع الإهتمام بالتطبيق على مشكلة الشرق الأوسط، وذلك من خلال أربعة أبواب كالتالي: (الباب الأول: الوسائل السلمية الدبلوماسية والقضائية، الباب الثاني: مبادئ القانون الدولي العام التي قررتها المحكمة، الباب الثالث: الحل السياسي، الباب الرابع: التسوية السلمية لمشكلة الشرق الأوسط).
