الكتاب في الأصل مخطوط ينقسم إلى عدة رسائل وأسئلة بدأ بـ "الكلام على حنث الناسي" ثم رسالة أخرى وضع لها المحقق عنوانا وهو "حتمية لا اجتهاد مع النص" ثم سؤالان عنونهما السبكي في أخرهم الأول في عتق القريب وسماه: "النظر المصيب في عتق القريب" والثاني: "المعلم في إتباع ما يُعلم"، ثم في نهاية المخطوط أسئلة فقهية من كتاب السبكي التمهيد اختارها المحقق وجعلها في آخر هذا الكتاب والمصنف هو علي بن عبد الكافي بن علي بن تمام بن يوسف أبو الحسن السبكي ولد سنة (683هـ)، تولى منصب قاضي قضاة دمشق سنة (739هـ) ومع هذا المنصب ولي خطابة الجامع الأموي وبشيخه دار الحديث الأشرفية والتدريس بالشامية البوانية وصنف على ما يريد مائة وخمسين مصنفاً في العلوم الشرعية والعربية وتوفي سنة (756هـ).
