تعتبر السيادة مفهوماً قانونياً - سياسياً يمثل أهم خصائص الدولة وسماتها الرئيسة، بل أنها تمثل شرطاً من الشروط الأساسية لإعتبار أي كيان سياسي دولة، وليصبح مهيئاً للإنضمام إلى المجتمع الدولي، كما يرتبط مفهوم السيادة بمفهوم الإستقلال والقدرة على ممارسة التصرف الحر على الصعيدين الداخلي والخارجي بكل حرية ودون الرضوخ إلى أوامر "الخارج".
ولما أن كانت العضوية في المجتمع الدولي قد أصبحت "ضرورة حياة" للدولة، بل أن معظم الفقهاء قد اعتبروا "الإعتراف" بالدولة من قبل الآخرين هو الركن الخامس من أركان كينونتها ووجودها، فإن السعي نحو الدخول في علاقات مع الدول الأخرى، يفرض على الدولة أن تعقد مجموعة من الإتفاقيات والمعاهدات أو تنضم إليها، وبالتالي فإنها، وإنطلاقاً من إرادتها الذاتية والمستقلة، تقّيد نفسها بما تفرضه مبادئ القانون الدولي وقواعده.
لقد ارتبط ظهور مبدأ "السيادة" في قانون الأمم مع إنبثاق الدولة القومية "الحديثة" في أوروبا في منتصف القرن السابع عشر الميلادي، حيث أقرت معاهدة وستفاليا (1648) مبدأ "سيادة الدولة" بإعتبارها تمثل السلطة العليا للدولة، ولا تحدها قيود، فبالتالي هي مطلقة في حدود الإقليم.
كما أقرت هذه المعاهدة مبدأ "السيادة" في العلاقات الدولية كمبدأ يكفل المساواة والتكافؤ بين الدول، ويمنع تدخل أحدها في شؤون أخرى، وأبرز مظاهر هذه القيود نجده في ميثاق الأمم المتحدة، الذي جعل صلاحيات هذه المنظمة وإختصاصاتها تشمل، إضافة للنواحي السياسية والأمنية، المجالات الإقتصادية والإجتماعية والثقافية وغيرها التي كانت تعتبر، تقليدياً، من صميم الإختصاص الداخلي للدول.
وهكذا فإن السيادة قد بدأت تواجه، في الوقت الحاضر، وضعاً صعباً بسبب القيود والضوابط والشروط التي تفرض على الدول وهي تمارس مظاهر سيادتها، إلا أن هذه السيادة بقيت الأداة الضرورية لتنظيم مفهوم الدولة وترتيب علاقاتها مع الكيانات السياسية الأخرى.
فمن هنا قامت الجدلية بين السيادة وبين القانون الدولي التي تناولها الأستاذ الدكتور عمر الحضرمي في هذه الدراسة القيمة.
