إن قواعد القانون الدولي الإنساني تهدف إلى جعل النزاعات المسلحة أكثر إنسانية عن طريق بناء حصون السلام في عقول البشر وترشيد الحرب من خلال اختيار أساليب ووسائل محددة في القتال، وعدم توجيه العمليات الحربية على غير الأهداف العسكرية.
فممارسة الدول لسيادتها يكون ضمن الحدود التي تقتضيها متطلبات الإنسانية لذلك فإن قواعد القانون الدولي الإنساني قد أقرت بغية تقييد سيادة الدول في هذا المجال بفرض مجموعة من الالتزامات على عاتق الدول والأفراد، وكل مخالفة أو انتهاك لها يعرض المخالف للمسائلة الجنائية أمام القضاء الجنائي الدولي.
إن مبدأ سيادة الدول في ظل هذه القواعد الموضوعية والإجرائية أضحى له مفهوم متبلور فتصريف الدول لشؤونها الداخلية والخارجية تراعى فيه حقو الإنسان في فترة النزاعات المسلحة.
