يتناول البحث بصفة أساسية موضوع "حماية الشهود في قانون الإجراءات الجنائية- دراسة مقارنة". وهكذا تجدر الإشارة بداية إلى أن نطاق البحث يقتصر على تلك الحماية القانونية التي يوفرها قانون الإجراءات الجنائية للشهود ليدرأ تعرضهم لأي نوع من أنواع الضغوط أو التهديدات التي قد يتعرضون لها أو غيرهم من أفراد عائلاتهم أو المقربين لهم. وبالتالي فإن موضوع البحث لا يتطرق إلى الحماية الجنائية للشهود في قانون العقوبات.
ولهذا يمكن تقسيم هذه الدراسة إلى ثلاثة مباحث، نعرض في المبحث الأول لتحديد موضوع الحماية، ونتناول في المبحث الثاني الإجراءات اللازمة لتوفير هذه الحماية، ونتصدى في المبحث الثالث لبيان قيودها، ويمكن أن نمهد لذلك بعرض فكرة عامة عن الشهادة، وخاصة في إطار القانونين المصري والفرنسي.
