لم يعرفوا متقدموا فقهاء المسلمين عقد التأمين بصورته الحالية، ولم يهتم به متأخروهم الذين أدركوا فاعتقدوا أنه لا يشيع بين المسلمين. لكن المؤلف يعرفه بالقول إنه "التزام طرف لآخر بتعويض نقدي يدفعه له أو لمن يعنيه عند تحقق حادث احتمالي مبين في العقد، مقابل ما يدفعه له هذا الآخر من مبلغ نقدي في قسط أو نحوه".
وهو برأيه تعريف يحتوي على أهم خصائص التأمين وأسسه التي يقوم عليها. والمؤلف يركز في كتابه هذا علة الحكم على التأمين من الناحية الشرعية، فيمعن النظر في الأدلة الشرعية والمستنبطة من مصادر الشريعة.
يقع الكتاب في ثلاثة أبواب عرض المؤلف في الفصل الأول لحقيقة التأمين وتوضيح عقده كما يريده ويتصوره القائمون عليه ومن غير تأثر بأقوال دعاة تجميل هذا العقد أو تقبيحه وبعيداً عن الفرضيات والخيالات التي لا وجود لها في واقع التأمين، وقد ركز في هذا الباب على تعريف التأمين ونشأته وانتشاره وبيان أركانه وأنواعه وما يختص به هذا العقد من بني سائر العقود والأهداف التي من أجلها أقيم وأثار الإيجابية والسلبية في حياة الناس.
أما في الباب الثاني فقد بحث المؤلف في حكم التأمين ومهد لذلك بذكر شروط العقد الصحيح في الإسلام كي يكون الحكم مبنياً على أسس علمية صحيحة مأخوذة من حصاد الشرع الحنيف. وفي الباب الثالث يعرض المؤلف حلولاً واقتراحات حيث ذهب إلى القول بأن ليس هناك نظام على وجه الأرض يؤمن الإنسان من غير شطط تأميناً حقيقياً في عيشه وماله ونفسه ودينه الأنظام الإسلام لذا فهو يعرض في هذا الباب للأمور التي يتكفل بين مآل المسلمين بالقيام بها، مما لا تحصل لغير المسلمين إلا بالتأمين.
