إن تطبيق العقوبات السالبة للحرية يمكن أن يؤدي إلى عزل المحكوم عليه وإقصائه عن المجتمع لذا ظهرت إتجاهات لدى الباحثين والمهتمين بإصلاح حال المحكوم عليهم تنادي بضرورة اللجوء إلى تدابير بديلة عن العقوبات السالبة للحرية من شأنها إصلاح المحكوم عليه وإعادته عضواً صالحاً في المجتمع، ومن هذه التدابير مراقبة الشرطة والتي تعد من العقوبات المقيدة للحرية وإن كانت تنفذ خارج السجون ويستهدف منه توفير معاملة خاصة لمن تنازل به بغية إصلاحه وضمان إئتلافه مع المجتمع، وإن مراقبة الشرطة تعتبر عقوبة بديلة تقوم على مراقبة سلوك الجاني للتأكد من إصلاحه ذاتياً بعيداً عن سلب حريته وإبداعه في السجن، حيث يترتب على حبسه تعرضه وأفراد أسرته وعائلته للعديد من الآثار السلبية.
وإذا كان الأمر كذلك، فلا بد أن يتبنى المشرع نظام مراقبة الشرطة في صلب القانون، ولكن هذا التبني يجب أن يكون بطريقة يتحقق معها الهدف المنشود، ومن هنا تظهر المهمة التالية لمهمة التبني، وهي كيفية التعامل مع النظام المتبني، وبعد ذلك تأتي المهمة الثالثة وهي كيفية صياغة النصوص التي تعبر خير تعبير عن الكيفية المذكورة.
