إن هذا البحث يتناول قضيةً فقهيةً مستجدّةً خطيرة في مجال المعاملات المالية المعاصرة - تعتبر بحقّ أهمَّ أدواتِ التحوّطِ من المخاطر الضارة بالنشاطات الإقتصادية، وفقاً لقواعد المبادلات المالية في الفقهِ الإسلامي - نظراً لإحتياج الناس إلى التعامل بكثير من صورها وفروعها وتطبيقاتها في المعاملات التجارية، والنشاطات الصناعية والإستثمارية والإقتصادية المختلفة؛ من أجل التحوّط (hedging) اللازم لحماية أعمالهم وأموالهم ومعاقداتهم وإستثماراتهم من التعرّض للفشل أو الخسارة أو السقوط في مهاوي الإفلاس ودركات الإنهيار المالي والإقتصادي، وإعتباراً لما يجلبُه من مصالح حقيقية، وما يدرؤه من مفاسد متوقَّعةٍ أو محتملة حتى غدا العملُ بها والبناءُ عليها مما لا يُستغنى عنه في المعاملات المالية المعاصرة، وصار مما لا يَسَعُ أهلَ التجارة والصناعة والزراعة والإقتصاد والأعمال المختلفة تَرْكُه وإهمالُه والإنصرافُ عن التلبّس به ومزاولته.
ومن الجدير بالبيان أنَّ هذه القضية في أساسها ومندرجاتها من مستجدات التعامل المالي المعاصر، لإبتنائها في الأصل على نظرية الإلتزام العامة في الحقوق المدنية والقوانين التجارية المعاصرة، وهي نظرية مستحدثةٌ في الفِقه الغربي الحديث، ولذلك فإنه لا مطمح في أن نجد في أصول الشريعة وفروعها نصّاً أو نصوصاً تشريعية؛ تبيّنُ أحكامَهَا، ولا أن نعثر في الفِقه الإسلامي الموروث وإجتهادات الفقهاء السابقين على بيانٍ شافٍ للغليل، أو عرْضٍ ناضجٍ وافٍ لأصولها ومبادئها، وفروعها وأقسامها وتفصيلاتها على نحو ما هو موجود ومقَرَّرٌ في نظرية الإلتزام العامة في القوانين والأنظمة الغربية الحديثة، وتطبيقاتها في المعاملات المالية والمصرفية والتجارية المعاصرة.
