ينقسم قانون العقوبات بدوره إلى قسمين: قسم عام وقسم خاص. فالقسم العام يشتمل الأحكام التى تسرى على كافة أنواع الجرائم والعقوبات، أو على معظمها، ويكشف على وجه الخصوص عن المبادئ العامة الموجهة لكافة قواعد التجريم. وقد اصطلح على تسمية هذا القسم بالنظرية العامة للقانون الجنائى. ومكانها فى نصوص التشريع الجنائى المصرى الكتاب الأول من قانون العقوبات المعنون "أحكام ابتدائية" ومن أمثلة ذلك الأحكام الخاصة بالشروع، والمساهمة الجنائية، وتعدد الجرائم والعقوبات. أما القسم الخاص -موضوع هذا الكتاب- فليس سوى مفردات الجرائم والعقوبات. ويحتويها الكتابان الثانى والثالث من نفس قانون العقوبات اللذان يضمان الجنايات والجنح المضرة بالمصلحة العمومية، ثم الجنايات والجنح المضرة بآحاد الناس، يضاف إلى ذلك كتاب رابع وأخير مخصص للجرائم قليلة الأهمية الموصوفة "مخالفات".
ونقتصر فى هذا المؤلف على دراسة بعض الجرائم الماسة بالمصلحة العامة والتى يكثر وقوعها فى العمل من ناحية، فضلا عما تثيره فى نموذجها الاجرامى من اشكاليات قانونية من ناحية أخرى. والحق أن معظم الجرائم من هذا المنظور سواء. ولهذا نضطر إلى اختيار طوائف ثلاث من الجرائم لتكون موضوعاً لهذا الكتاب: الجرائم الماسة بالوظيفة العامة، وجرائم الاعتداء على المال العام، وجرائم التزوير -وهو ما نبحثه فى ثلاثة أبواب على التوالى.
