يهدف البحث إلى دراسة النظام القانوني وقواعد التحكيم في المشروعات الإستثمارية من خلال البناء والتشغيل ونقل الملكية B.O.T من النواحي القانونية والإقتصادية، وطرق إنهاء النزاعات التي قد تنشأ أثناء تنفيذ المشروع وذلك من خلال تعرفي هذا النظام وإلقاء الضوء على النظم الأخرى المشابهة له، ومدى نجاحها أو فشلها في بعض الدول، والبحث عن الطبيعة القانونية الخاصة لهذه العقود من خلال نظام الـ B.O.T والمراحل التي يمر بها، وفي ذلك محاولة لبناء نظام متكامل يمكن إتباعه في تطبيق أسلوب عقود البوت، لتعظيم الإستفادة منه، وينطلق البحث من إفتراض أن اسلوب البوت في تنفيذ مشروعات البنية الأساسية هو أحد الخيارات المتاحة أمام الحكومة في الغالب بعد دراسته بإرادتها ولرؤيتها إنه الأفضل، وبالتالي لابد من وضعه في الاعتبار عن إعداد دراسات الجدوى الإقتصادية لمشروعات البنية الأساسية، كما يهدف البحث إلى إلقاء الضوء على نظام التحكيم في عقود الـ B.O.T كنظام حديث في فض المنازعات تقبله أغلب الدول واصبح مسلماً بجدواه في مختلف الدول لفض المنازعات التي تنشأ عن عقود الإستثمار.
