تختلف قواعد الإختصاص القضائي الدولي عن قواعد تنازع القوانين في الإعتبارات التي يبنى عليها كل منهما، فالمشرع عند تحديده حالات إختصاص محاكمه بالمنازعات التي تتضمن عنصراً أجنبياً يراعى عدة إعتبارات تختلف عن تلك التي يراعيها عند تحديد القوانين الواجب التطبيق، فغالباً ما يبنى الإختصاص القضائي الدولي على إعتبارات متعلقة بحسن إدارة العدالة وتحقيق الأمن العام داخل الدولة، أما الإعتبارات التي يراعيها المشرع عند تحديد القانون الواجب التطبيق على المنازعات الدولية فهي تتمثل في ضرورة إختيار القانون الأكثر إتصالاً بالنزاع.
كما أن الخصائص المميزة لقاعدة الإسناد تؤدي إلى المزيد من الإختلاف والتباين بين قواعد الإختصاص القضائي الدولي وقواعده الإختصاص التشريعي، فإذا كانت قواعد الإسناد تتميز بأنها قواعد مزدوجة غير مباشرة، فإن قواعد الإختصاص القضائي الدولي تتميز بأنها قواعد مباشرة، حيث أنها تفضل بطريقة مباشرة في مدى إختصاص المحاكم الوطنية بحكم النزاع، وتتميز كذلك بأنها قواعد مفردة الجانب حيث تحدد فقط حالات إختصاص القضاء الوطني دون أن تتعدى ذلك وتحدد حالات إختصاص المحاكم الأجنبية.
ويتناول هذا الكتاب دراسة القوانين الدولي الخاص العماني، وقد خصصناه لدراسة موضوعات تنازع القوانين وتنازع الإختصاص القضائي الدولي وتنفيذ الأحكام الأجنبية في سلطنة عمان.
