" مقدمة المسألة الفقهية لدى المسلمين من تفاريق الإستملاك المذهبي إلى الفكر المقارن " عنوان يشتمل على موضوعات في الفقه الإسلامي ومسائله من فتوى واجتهادات شرعية ، ومسائل فرعية ومذهبية نصّ عليها أئمة المذاهب ، أو خرّجها العلماء اللاحقون بما يوافق قواعد كل مذهب .
في ضوء ما سبق اهتم المؤلف عبد اللطيف الحرز في بيان طريقة المسألة الفقهية في محاولة لاستخلاص مضمرات نصوص تقديمها ، فعمل على رصد الشواهد في القرآن الكريم ، والأحكام متجاوزاً المذاهب المختلفة ويعلل ذلك بقوله " لأن الفقه بحثاً في الوجود ، وإنما تكون المسألة فقهية كون متلقيها ينظر غليها كونها كذلك ، فهي بهذا فقهية جمعت العنونة وتوجيه الخارج الدنيوي ، والرؤية الكونية العامة في الديانة الإسلامية " ، ويعني بذلك أن المسألة الفقهية " يصح نسبتها لكل مذهب حتى لو كان إمام المذهب المخصوص لم يقلها وينص عليها لأنها لا تتصادم مع كبريات القواعد والأصول ... " . وإن كل ملّة لها وظائف دينية يكون لها فقه وأصول وكلها مستمدة من كتاب الله تعالى .
يتوجه المؤلف بكتابه إلى طلبة العلوم الدينية ورجال المؤسسات الدينية والغاية هي تثقيفهم " يكون المسألة الفقهية قضية في الحياة ونشاط علاقتنا مع مخلوقاتها وليس هي قضية تفريعات كتبية وصوتية " .
