تعتبر مناهج البحث فى العلوم القانونية من الأمور التى لا غنى عنها للباحث القانونى. سواء كان هذا الباحث يكتب فى مجال البحوث النظرية أو التطبيقية أو يتناول مشكلة قانونية ما بأسلوب علمى متعارف عليه أو جزئية علمية قانونية لم يتطرق إليها أحد بالبحث قبل ذلك بهدف إضافة الجديد إلى المعرفة القانونية، وذلك لأنه لا غنى للباحث فى العلوم القانونية عن الاطلاع على مناهج البحث فى العلوم القانونية. وإن كانت على مستوى المكتبة العربية النادرة، ولذا عملنا على التصدى لهذا العمل من خلال وضع هذا المؤلف أمام الباحث فى العلوم القانونية وغيره من الباحثين فى العلوم الإنسانية الأخرى.
وهدفنا من هذه الدراسة مساعدة الباحث على فهم كيفية عمل بحث علمى فى المجال القانونى من خلال معرفة المفاهيم والأسس التى يقوم عليها البحث القانونى والاختيار السليم للمشكلة محل البحث، واختيار أنسب الطرق لجمع المادة العمية، والتوصل إلى حقائق نثق فى صحتها. بالإضافة إلى تزويد الباحث القانونى بالمعرفة، وإعداده الإعداد الجيد من قبل الجهات المعنية من خلال تزويده بالمهارات التى تجعله قادر على تصميم خطة البحث، وتنفيذها، وأهمية التزود بالخبرات التى تجعله قادر على القراءة التحليلية الناقد لما كتبه الغير من بحوث وتقييمها والحكم عليها. مع التركيز على الإعداد الخلقى والعلمى من خلال عرض تاريخى لتطور البحث العلمى، وتحديد ماهية البحث العلمى، وأهدافه، وأنواع الأبحاث العلمية، والمناهج المختلفة للبحث العلمى، والشروط الواجب توافرها فى الباحث، وكيف يمكن تحقيق التعاون فى الأبحاث الجماعية، وأهمية التصدى للمعوقات المادية، والبشرية التى تحول دون تقدم البحوث العلمية بصفة عامة، والبحث فى العلوم القانونية بصفة خاصة.
